Each Application should be site specific and include student mem count and<br \/>\napplicable leases for that site.<br \/>\nNew Mexico state law provides that the Public School Capital Outlay Council (PSCOC) may approve<br \/>\nApplications for the purpose of making lease payments for classroom facilities. The PSCOC will make<br \/>\ndetermination of the lease assistance awards based upon compliance with current statutory criteria. If<br \/>\napplicable to your charter school, provide a copy of the Certification(s) and Lease Amendment submitted with<br \/>\nyour 2017-2018 Lease Assistance Application or complete and include the applicable Certifications listed<br \/>\nbelow:<br \/>\nCertification A Public Facility;<br \/>\nCertification B No Public Facility Available;<br \/>\nCertification C Facility Owner &#8211; Non-Profit Foundation, and\/or<br \/>\nLease Amendment Owner Maintains Facility to Statewide Adequacy Standards.<br \/>\nAt the end of each fiscal year, any unexpended or unencumbered balance of the grant award(s) will<br \/>\nrevert to the Public School Capital Outlay fund. No grant will be made for lease payments due pursuant to a<br \/>\nfinancing agreement under which the facilities may be purchased for a price that is reduced according to the<br \/>\nlease payments made unless:<br \/>\nIt is a Lease Purchase Agreement approved by the Public Education Department (PED) pursuant to the<br \/>\nprovisions of the Public School Lease Purchase Act, Section 22-26A-4. NMSA 1978.<br \/>\nINSTRUCTIONS:<br \/>\n1. Attach a complete and signed copy of the current or proposed Lease Agreement,<br \/>\nLease Purchase Agreement and\/or any Lease Amendments, Inter-Governmental Agreements,<br \/>\nMemorandums of Understanding or Joint Powers Agreements for the 2018-2019 school year<br \/>\n(July 1, 2018- June 30, 2019) to the Application.<br \/>\n2. Each Application submitted must include a signed copy of the PSCOC\u2019s Conflict of Interest<br \/>\nQuestionnaire and a copy of the school district or charter school Conflict of Interest policy.<br \/>\n3. The Administrative team and<br \/>\ngoverning council members worked very hard with APS and the surrounding community<br \/>\nto help locate a facility large enough to support the Schools Academic needs as well as<br \/>\nanticipated growth needs. Multiple sites were considered, however with the built in safety<br \/>\nof the Cutler Facility, this deemed the most appropriate for our Students and Staff.<br \/>\nQuestion 2: Briefly describe how the lease premises support the current or future space needs of the<br \/>\ndistrict\/school. The current facility and room for expansion help to support student<br \/>\ngrowth and expansion. We will be able to add additional classrooms, a Gym to support<br \/>\nAthletics, a Music room to support multiple programs offered at our school.<\/p>\n<p>Question 3: Briefly describe how the determination was made that the negotiated lease was at or<br \/>\nbelow fair market value.
