RESOLUTION ADOPTING AND AFFIRMING SECOND AMENDMENT TO LEASE<\/p>\n
PURCHASE AGREEMENT
\nResolution 1-21-19-1<\/p>\n
WHEREAS,\u00a021st Century Public Academy has negotiated a Second Amendment to the
\nLease Purchase Agreement dated August 9, 2017; and
\nWHEREAS, that certain Second Amendment to Lease Purchase Agreement, a copy of
\nwhich is attached hereto as Exhibit #1, was approved by the State of New Mexico Public
\nEducation Department via correspondence dated January 14, 2019, a copy of which is attached
\nhereto as Exhibit #2; and
\nWHEREAS, it is in the best interest of 21st Century Academy to adopt and affirm such
\nSecond Amendment to Lease Purchase Agreement;
\nNOW THEREFORE, be it resolved by the Governance Council as follows:
\nThe Governance Council of 21st Century Public academy does hereby adopt and affirm the
\ncertain "Second Amendment to Lease Purchase Agreement" attached hereto to be effective upon
\na dated to be specified by the Lessor and agreed to by 21st Century Public Academy; and to
\naccept and knowledge the prior approval of such "Second Amendment to Lease Purchase
\nAgreement" as attached hereto as Exhibit #1, by virtue of correspondence from the State of New
\nMexico dated January 14, 2019 as attached hereto as Exhibit #2. Further the appropriate officers
\nare directed and granted full and actual authority to execute the "Second Amendment to Lease
\nPurchase Agreement" at such time and under such circumstances as are proper in the sole
\ndetermination of such officers.
